Flickr permission question

A user on Flickr who has many photos of Pennsylvania state parks agreed in early October via a Flickr email to me to license all of them for use here (CC-BY-SA license). I told him that he should send an email to Commons OTRS releasing the images in that set on Flickr under a free license, and that would suffice (and then we could upload the images that were useful and add a template with the OTRS ticket / permission). FYI, the PA State Parks set is here on Flickr.

The problem is that the user still has not sent the email to OTRS to my knowledge (I asked him to copy me, but have received no CC or BC). Also the license of File:Buchanan's Birthplace State Park Pyramid.jpg (from the set) which is now on Commons is still OTRS Pending. He recently posted this to his talk page on the English Wikipedia. Ignoring the obvious problems with his post there (no free license specified, not sure what the Flickr Universe is, etc.). I am nearly 100% sure that it needs to be an OTRS email, not a Flickr mail or a Wikipedia talk page posting, right? I was not able to find anything searching on "PA State Parks", "Pennsylvania state parks" or "*cngodles*". You might want to pester him again (-; Did you consider asking him to change the license in Flickr to Creative Commons (tell him NOT to chose NoCommercial and NoDerivative). Yes, if the user wants to license all the photos under a free license, then it is just one click in the flickr menu. Much easier than sending an e-mail. Saves OTRS time, as flickrreview is already set up to do that, plus we have bots to upload the files. Furthermore, there is no way to send flickrmail to OTRS without forwarding it, so it isn't possible for us to verify the identity of who is sending the e-mail, without them some how editing their account. -Andrew c (talk) 15:19, 6 November 2009 (UTC)

The ticket seems to cover all images at soccer.ru. However, the bulk of the ticket is in Russian, so perhaps someone else can confirm the validity and text. -Andrew c (talk) 14:56, 5 November 2009 (UTC)

It may help if you could be more specific on what needs resolving. The image in question has passed OTRS. Why does it need review? Do you have additional evidence that the image is a copyvio or something along those lines? Or are you trying to see if you can upload more images from that webpage under the terms of that ticket? or some other situation? -Andrew c (talk) 18:09, 5 November 2009 (UTC)
The permission covers all the images from soccer.ru. The last reply in Russian can be translated as "put hyperlinks and feel free to use [the images under Creative Commons Attribution-Share Alike]". Is that what is needed to be translated? --Blacklake (talk) 18:46, 5 November 2009 (UTC)

You may want to contact the user who added the pending template to the image. Normally for these, the person who added the pending is the person who handled the ticket, and they are normally the best person to close it out. I've examined the ticket. It's in German, but with a fairly straight forward translation. The initial permission wasn't adequate, and nothing came in after the first reply from us, so at this point, I'd think it would be safe to simply delete the image, and restore it if a reply is ever sent in. The e-mail in the OTRS system doesn't content a valid permission, another response of the uploader or sender of the e-mail is not to be expected, I think. I agree with Andrew - we should delete. If necessary we can restore the file. Yellowcard (talk) 13:15, 10 November 2009 (UTC)

requesting permission confirmation for Now That's What I Call Music! album covers

Category:Pop albums contains several Now That's What I Call Music! album covers, all of them uploaded by Kingskip09 (talk · contribs), who claims to be the copyright holder. I know I should assume good faith, but my gut feeling is telling me that these are blatant copyright violations. Even if Kingskip09 were indeed the designer of those covers, I believe releasing such covers under a free license would require permission from Universal, EMI, Sony Music and Virgin Records. Assuming that this was the case, the description pages should have an OTRS template, which none of them have. Can anyone please confirm whether Kingskip09 is indeed the copyright holder? Template:Attribution-Ubisoft listed for deletion (again)

{{Attribution-Ubisoft}} has been listed for deletion again, this time at Commons:Deletion requests/Template:Attribution-Ubisoft 3. (For the record, the template has previously been listed for deletion twice, both times by the same user, and it had survived both DRs.) According to the template, Ubisoft allows players to release screenshots of its games under a free license, which has been verified by the OTRS team. However, the nominator's "new" concerns are that the employee in question did not have authority over copyrights, and that the OTRS e-mail exchange does not explicitly indicate that such screenshots could be used under a free license. What is more troubling, however, is the employee's claims that Ubisoft has the right to have certain images removed (free licenses cannot be revoked). Other uses have also pointed out that it was unlikely for a large game company like Ubisoft to allow users to allow players to use its games' contents for any purpose.

Hello! I stumbled across these photos from soccer.ru en:File:AArshavin.jpg File:D-Bulykin.jpg with OTRS permission. As there are still many footballers without a photo, I wonder what permission was given by the site, whether I'm allowed to use other images from the site for Wikipedia purposes and what steps I need to follow to get OTRS permission for them? Is this ticket really valid? How can she own the rights to the picture, if she doesn't even know who the author is (the only way for her to become the copyright holder is to have a contract with the photographer specifically transferring the rights to her, in which case she'd surely know his name)? Not in a permissions queue, so I cannot access the ticket. If I had to guess, I'd say it's in the Norwegian info queue. Often we do get tickets from the subject saying "I am the copyright holder, and release it under free license X". And with official photos and/or headshots (which this appears to be), it seems entirely likely and plausible that they do won the copyright (and as long as we have a clear statement of declaration on file, we don't question the veracity of their declaration). It's probably the case that she just didn't mention the name of the photographer, and that isn't necessarily part of the OTRS process. We are looking for "who owns the copyright" and "what license are you using". Hopefully, someone who speaks Norwegian can fill in the details if my assumptions are wrong. Okay then. I still wonder who the picture should be attributed to, in order to comply with the license. Even though she owns the rights, she's clearly not the author, so it's a bit weird to just credit her. But strictly from a copyright point of view, all is fine; it's just a bit fuzzy on moral rights. still pending?

Hi colleagues,
around October 27th I've uploaded about 50 images from a friend (all in Category:Images by Bojin), who confirmed permission to OTRS the same day. However, as of today (November 15th) OTRS clearance is still pending. Though it's a bunch of images, it will be only one ticket for all. Could somebody take a look into that? This is a German language ticket. Looks like that queue is backlogged about 50 days, and therefore there are about 30 tickets in front of yours. It's an unacceptable response time on our part, I know, but I guess we are in need of more German speaking respondents. Sorry for the wait. It does not look OK (yet).
The message above (from the rights holder) reads: "I wouldn't have anything against it. Which pictures would you mean and what is it for?" The message below is a reply to that, explaining that the pictures are meant for Wikipedia. The third and most important message, stating that the author agrees with that, is missing. My pictures where deleted

I have some problems whit my account on wiki-commons, there where three pictures in my account and now they where deleted on falls grounds (some one claimed copy right over my pictures).

The three pictures are the following: File:MildAdh Web.jpg File:Abrassiv Web.jpg File:SevereAdh Web.jpg

The pictures in question where inserted in an wikipedia article on the subject galling. I would be very happy if my pictures are reinstate in the article and also are made accessible on the wikipedia commons as they where before this problem appeared. I have full copyright and ownership over my pictures but according to Wizard191 (talk) I must talk to an administrator at the Commons to get them undeleted. (The whole discussion can be read in the end of this message)

Hi. I donated three pictures from my own work and research to the wikipedia commons. I have full owner ship and copy right of the pictures and I want to make them public and free and also to be used in the article galling found in the wikipedia archive. Please help me get my pictures back and if not, please guide me through the authorization and download process. I don´t think diva-portal.org claims copyright to the three pictures because the diva-portal.org is not the owner and publisher of my original. I published my examination report including the three pictures using the library at Karlstaduniversity (kau.se).

The conditions I publisch my work under was clear, I have full owner ship over my work and if somebody claims copyright I waqnt to know who they are. Harald, the chances are good that you can get this sorted out, you probably will just need to e-mail DIVA or your university administration. They will know more about the copyright of self-archived content in institutional repositories in general as well as in regard to them in particular. Hi. I have spoken to both the library at Karlstad University and Diva.org. The message was clear, I have full owner ship over my work and the published pictures according to the contract between myself and the two publishers(see § 5 bellow). Even if I give the pictures away to some one and let them use them I still have the the main copyright, den ideala upphovsrätten(Swedish), which never can be lost. In other words, I can give them away to an infinite amount of people. I can also make new pictures on the steel plates because I have the original material.


§ 5 Transfer of the Author?s Rights Any transfer by the Author of the copyright to the Work shall not affect the rights of the University under the Agreement. This agreement regarding electronic publishing shall not impose any limitations of the Author?s right to make use of the Work.


I can give you the whole contract if you want or the diva.org contact but I hope it´s not necessary, I would be very happy if my pictures are reinstate in the article and also are made accessible on the wikipedia commons as they where before this problem appeared, thank you in advance. Diva.org and my self would also like to know who claims owner ship over my work in their (Diva.org) name. Anime Nut ticket

Hiya... I'm wondering if someone can do me a favour and pass along some details about what a ticket covers. I'm trying to source images of porn stars and I see there's an OTRS ticket for a number of images from the Flickr account of Anime Nut (e.g., File:Hillary Scott 2007 2.jpg) where the Flickr license is still listed as "copyright". Ticket # is 2007081610000479. I'm just curious as to what the terms of release are - can we take any image from the site we find? Only specific/specified images?? There is a long list of images which have already been uploaded that the Flickr user agreed to. I wouldn't say that the user's flickrstream is fair game under this ticket. However, the user seems agreeable, and if you see more images you like, you may want to contact them personally (and to avoid the OTRS wait time, you could just ask the user to change the license on Flickr). Hi Parrot of Doom, unfortunately I was unable to find an email by Paul Hindle in the OTRS system relating to this image. The last email we received from the owner was related to a case in 2008. Please ask him to send an email or send yourself an email including the email address of Paul Hindle. In the latter case we will contact him ourselves and ask for confirmation. Could you check the OTRS ticket for this image? I find it unlikely that Allison Harvard contributed it as her surname is incorrect in the filename and author name and it is sourced to "4chan.com/b" - Harvard wouldn't have to source her own self-portrait from 4chan. The pic is also smaller than the largest size I can find using TinEye, which is 600x938. Fences and windows (talk) 00:58, 23 November 2009 (UTC)

Both on October 10 and November 3 I sent an email to the Contact address for the Netherlands to get the OTRS clearance done for the two images: File:Mami Awuah Asante 1.JPG and File:Mami Awuah Asante 2.JPG. Permissions should be sent to permissions-nl@wikimedia.org, or (if in English) permissions-commons@wikimedia.org. This is because there are more users with access to permissions emails than info-nl, so it is dealt with faster and is easier to verify. Stifle (talk) 10:06, 24 November 2009 (UTC)

Two files

They are tagged with {{no license}} (more than a week now). The first one apparently has a ticket on the OTRS (but has no link to the ticket in question nor there is an OTRS agent listed on the page history putting the template), the second one is "on hold". Need an uninvolved OTRS-volunteer

In Commons:Undeletion_requests/Current_requests#Image:Portail_Sylvipedia_Illustration.jpg I asked author for a permission and got one (https://ticket.wikimedia.org/otrs/index.pl?Action=AgentTicketZoom&TicketID=4095207). I think we should let another OTRS-volunteer to look at it so we have two pair of eyes on it. Hi MGA73, I've read the ticket and can confirm it. In his statement, Mark A. Taff puts all images which were uploaded on any Wikimedia project as of November 26, 2009 and put under {{GPL}}, version 2 or 3, under the {{Cc-by-sa-3.0-us}} license. en:User:InkHeart OTRS check

I need an OTRS Check for uploads with the claim of images beeing provided via photosubmission, uploaded by various sockpuppets.

I suspect File:Lee Jun Ki 2009 JapanFM Press Conference.jpg beeing the bad guide for that user. The author of this image is written in the EXIF, he repeated the author for en:File:SongSeungHun2008.jpg e.g. where it is not written in the EXIF. --Martin H. (talk) 23:28, 26 November 2009 (UTC)

The ticket numbers 2009112610004847, 2009112610001564 and 2009112610002489 (the first three Commons files) and 2009111010006653 (on en:File:SongSeungHun2008.jpg) are not valid, and I cant find applicable tickets via a search on the filename. The ticket link on en:Special:undelete/File:ParkSiYoun2009.jpg tells me I don't have permission to view the ticket.

The tickets for File:Aoi Miyazaki 2009 Elan D’or Awards.jpg, File:LeeJunKi BDAY.jpg, File:Sang-mi 23.jpg, en:File:Lee Jun Ki K&C.jpg do exist and were approved, but I haven't reviewed those permissions carefully. The deletion of the images on en.wp not makes it easier for non-admins ;) Thanks for your notes, including an incomming ticket for File:Episode_II_Shanghai.jpg in a comparison might be a good idea. I gave the above list some optical   marks according to your comments so that I will not forget to delete them.
I suspected File:Lee Jun Ki 2009 JapanFM Press Conference.jpg (uploaded August 7 2009 by User:J Milburn) to be the example for InkHeart to fake photo submissions, the author name Yu Sama Katasomichi is the same name he used for en:File:SongSeungHun2008.jpg, uploaded on November 13. Above Ytoyoda called the author name jibberish, so maybe the correctly uploaded photosubmission File:Lee Jun Ki 2009 JapanFM Press Conference.jpg needs a check too, InkHeart was active in August already and long time before. --Martin H. Again an addition: I just checked some older IP edits and found User talk:ColleenC16. File:Aoi Miyazaki 2009 Elan D’or Awards.jpg (Yu Sama Katasomichi, OTRS photo-submission) was uploaded shortly after ColleenC16 flickrwashed a batch of photos of Aoi Miyazaki. Request for check on ticket #2984812

Hi, ticket ID #2984812 was attached to File:Third Reich AH.JPG by MBisanz on 24 May 2009.[2] The issue is that the board game is copyrighted to Avalon Hill and per Commons:Image casebook#Board games, unless the game is trivial in a photo, it is considered a derivative work in violation of copyright. Multiple ticket

Yes, sure. You can send an e-mail with the standard permission text, but with a references to something like "any picture taken by me and uploaded by User:X" instead of the name of the picture, and the OTRS agent will be able to set up a custom license/permission template just for you, if the permission is validated (or he will simply put the same OTRS ticket on all the files). --Eusebius (talk) 15:44, 3 December 2009 (UTC)

I recieved a message from the author releasing the image under CC-BY-SA that I forwarded to permissions-commons:

I agree to publish that work under the free license CC-BY-SA version 3.0."

However, the author has not responded to requests to change the licence on the flickr page. I guess the file will have to be deleted.

Blanket permission

I had obtained permission for a whole bunch of images that were uploaded on behalf of a contributor. The ticket for some images has been logged https://secure.wikimedia.org/otrs/index.pl?Action=AgentTicketZoom&TicketID=800694 - for instance File:IridescentShieldtail.jpg - at that point it seems the handler did not include the ticket for File:Chrysomelid_wynaad.jpg - perhaps someone can verify this and do the needful. This file states: "Wichor Bramer, Stationsweb.nl Wichor heeft schriftelijk toestemming gegeven dat zijn foto's op Wikipedia geplaatst mogen worden. Zie de kluis voor de toestemmingsmail." - translates as "Wichor Bramer, Stationsweb.nl. Wichor has given written permission that his photos can be placed on Wikipedia. See the vault for permission email". There is no OTRS ticket on the file, and the licensing is a "Self" license which would then be incorrect. “The vault” was a system used by the Dutch Wikipedia before OTRS was used by Wikimedia. All vault-files are now saved into OTRS ticket:2008060410029446. However, I was unable to find the specified-permission. I might be missing something, so I’ve asked some other Dutch OTRS-volunteers to look into this. I just happened to come across another few files from that website, and I then checked the licensing. The website is a private collection of old photographs mostly with no author specified. In this case, the source is the webmaster, Wichor Bramer. The site however mentions no specific license for use. Not sure how these files would need to be licensed. I recently completed my first upload, a photo of the Abendgymnasium Köln, taken by the Montag Stiftung Urbane Räume (which means something like Montag Urban Spaces Foundation) for an article I am writing on. Their project leader Mrs Kirstin Gehm gave permission to use it under the Creative Commons Attribution 3.0 Unported, but unfortunately her mail (which i forwarded to permissions-commonswikimedia.org) was in german (though very simple, I guess Google is able to translate it correctly).

Well, under this conditions it is probably the correct item, the permission from Bernhard Eichkorn, written in Esperanto. There should be a scanned paper, therefore an automatic search isn't able. I think there is now a special permissions-eo@wikimedia.org address. Is it able to move this Esperanto item there or not? OTRS check pls

Heya... I spotted this image - File:KatherineH.jpg - which states in the description that the author is "AP Photo/Dan Steinberg", and tracking back to the Flickr page it came from shows the license there is "All rights reserved". Now normally I'd just blow it away as a blatant copyvio except... there's a OTRS pending tag on the image, and given that it's copyright to the Associated Press, I have a very hard time figuring out how someone can get the image released to the public domain. Can someone check to make sure there's nothing in the OTRS queue tagged with this image?? Tabercil (talk) 23:37, 18 December 2009 (UTC)

OTRS Pending on photos by Tom Frost

I am Jim Heaphy, user Cullen328. I have uploaded several photos taken by Tom Frost, with his full knowledge and permission, and he has agreed to license his photos under Creative Commons Attribution Share Alike, version 3.0. He signed a letter to that effect, which was mailed to Maggie Dennis at the Wikimedia Foundation. Unfortunately, the wording of that letter was not quite specific enough despite my best efforts, so Maggie Dennis drafted a second version that made his permission crystal clear. Please be aware that Mr. Frost is about 80 years old and does not use a computer or email. I communicate with him by phone or the U. S. Postal Service. He guards his privacy and can be slow to respond, but he has been unfailingly supportive of having his photos on Wikimedia Commons. I have mailed him the revised letter for his signature, and will send it to Maggie Dennis as an email attachment with hard copy mailed as soon as he mails it back to me. Under these circumstances, I would be grateful if the Tom Frost images on Wikimedia Commons can stay there in the mean time.   • I have received the signed copy of the revised permission letter from Tom Frost, and I will submit it by email, and will then mail the signed original to the Wikimedia office in San Francisco, attn: Maggie Dennis. Permission using image?

Hi

I am the author of the Norwegian Wikipedia page "Østfold Fylkesbibliotek". http://no.wikipedia.org/wiki/%C3%98stfold_fylkesbibliotek

I have also taken the photo that is on the page. For some reason I was sent a message a few days ago stating that the photo file is up for deletion because permission had not been granted for use of this picture on the site. I don't understand this, because I am the photographer of that picture.

The template was added by a bot, because you tagged your image with {{OTRS pending}} when you uploaded it but never sent an email. In this case, no permission is required since it is your own work, so I've removed the {{No permission}} tag. In the future, just remember that you don't need to use {{OTRS pending}} for your own work; you only need to send permission when uploading someone else's work. –Tryphon 09:47, 21 December 2009 (UTC)

I noticed that this image is a reduced version of this photograph found at an Italian basketball club's official site. The upload log has a number string "2008062410016921" that appears to be its OTRS ticket number. Could someone confirm this ticket and update the licensing information? Thanks much.

Dirty Diaries

Images in Category:Dirty Diaries are being threatened with deletion because of a missing OTRS, but when I contacted Mia Engberg, the director of the film, she claims to already have sent a permission e-mail. I don't know exactly when, but it could have been as early as October, quite soon after the images were uploaded. The permission e-mail should be from the adress mia-at-story.se. Could someone look into this?

First time I've ever heard of NC-ND despite having edited Wikipedia for close to five years. Do you realize that NC-ND isn't even mentioned at Commons:Copyright tags? There really needs to be an easier way to find this information for experienced users and newbies alike.

That's probably because Wikipedia/Commons doesn't accept NC or ND tags, so they're not emphasized as much. The Creative Commons' listing for all their copyright tags are here. Commons:Creative Commons copyright tags mentions those other tags. The Commons upload form for works from Flickr shows a box of which Creative Commons licenses are acceptable [4] and so does Wikipedia's counterpart [5]. The declaration of consent alone appears to disallow NC-ND. So what would be the point of asking whether they want one or not? From my experience of a similar case it seems as if not all OTRS volunteers are quite as specific about these things.

Mary Rose Trust release

I'm going to upload a group of images donated by the Mary Rose Trust in conjunction with a press release on January 3. After some queries at #wikipedia-commons, we agreed that the actual permission could be granted before the actual upload. The permission would specified the number of files to be uploaded and myself as the uploader. To clear the images for use on Wikipedia the day of the press release, however, I need the OTRS ticket number well in advance. Could someone check the ticket number? The permission e-mail was sent on December 22 from charlesfjbarker@gmail.com.

Following up on a notice left on my talk page regarding the eight pictures

I have just sent an e-mail to permissions-commons-de@wikipedia dot org. While I had received oral authorization to pubish Kilian's pictures at the time of uploading, I wanted to upload further pictures of his collection before providing one single formal e-mail authoriztation for ORTS regarding the entire bunch. Since further pictures didn't make their way to Wikipedia yet, I have now asked for formal permission for the eight pictures in question, stated above.
